Registration Terms
and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the Tactical Aquatics website, services, and training programs (collectively, the “Services”). By registering for any course or accessing the Tactical Aquatics website (the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms.

 

1. Acceptance of Terms

 

By accessing, browsing, or using the Site or registering for any Tactical Aquatics course, you agree to comply with these Terms. Tactical Aquatics may update or amend these Terms at any time without prior notice. Continued use of the Site constitutes acceptance of the revised Terms.

 

1. Ownership and Intellectual Property

 

All content on the Site—including text, graphics, images, videos, course materials, digital media, logos, and trademarks—is the exclusive property of Tactical Aquatics or its licensors. This content is protected by copyright, trademark, and intellectual property laws.

 

You may not reproduce, modify, distribute, publish, broadcast, or create derivative works from any content without prior written consent from Tactical Aquatics.

 

1. Permitted Use

 

You may use the Site solely for personal, non‑commercial purposes. You agree not to:

• Copy, republish, or distribute Site content.

• Reverse engineer, decompile, or attempt to access source code.

• Interfere with the Site’s functionality or security.

• Use the Site for unlawful or prohibited purposes.

• No rights or licenses are granted to you except those expressly stated in these Terms.

 

1. Registration Requirements

 

Registration is complete only when full payment is received. You are responsible for reviewing all course prerequisites before registering. Tactical Aquatics is not responsible for students who register for courses they are not eligible to attend.

 

Providing false or incomplete information may result in removal from the course without refund.

1. Prerequisites and Eligibility

 

Many courses require specific prerequisites (e.g., age, certifications, swimming ability). You are responsible for ensuring you meet all prerequisites before the course begins. Failure to meet prerequisites does not qualify for a refund or credit.

 

1. Refund Policy

 

All refund requests must be submitted by email to info@tacticalaquatics.ca The timestamp of your email determines eligibility.

1. Rescheduling Policy

 

Rescheduling requests must be emailed to info@tacticalaquatics.ca Once rescheduled, a course becomes non‑refundable.

1. Course Materials

 

Purchased or rented materials are non‑refundable once received. Rented materials must be returned in same condition; damage or non‑return will result in full replacement charges plus HST.

 

Online‑only courses and digital products are final sale.

 

1. Attendance and Certification

 

You must attend all required sessions, complete evaluations, and participate fully to be eligible for certification. Missed sessions, late arrivals, or incomplete participation may result in failure to certify, with no refund or credit.

 

Certification is not guaranteed and must be earned.

 

1. Code of Conduct

 

Tactical Aquatics maintains a safe, respectful learning environment. You may be removed without refund for:

• Harassment or inappropriate behaviour

• Disruptive conduct

• Failure to follow safety instructions

• Being under the influence of drugs or alcohol

• Violating facility rules

 

Tactical Aquatics reserves the right to refuse service at its discretion.

 

1. Third‑Party Sites

 

The Site may contain links to third‑party websites. Tactical Aquatics does not control or endorse these sites and is not responsible for their content, accuracy, or security. Accessing third‑party sites is at your own risk.

 

Tactical Aquatics will never sell your personal information to third parties.

 

1. Payments

 

All fees are due at the time of purchase. You are responsible for all applicable taxes.

 

You authorize Tactical Aquatics and its third‑party payment processors to:

• Process payments using your provided payment method

• Store payment information securely

• Charge your payment method for course fees and any outstanding amounts

• You represent that you are authorized to use the payment method provided and that sufficient funds or credit are available.

 

Tactical Aquatics is not liable for incomplete transactions due to insufficient funds or payment processor issues.

 

1. Indemnification

 

You agree to defend, indemnify, and hold harmless Tactical Aquatics, staff, contractors and its partners from any claims, damages, liabilities, or expenses arising from:

• Your breach of these Terms

• Your use of the Site or Services

• Injury, property damage, or incidents occurring during training

• Failure to follow safety instructions

• Interactions with other participants

• Payment disputes or chargebacks

• Intellectual property violations

 

This obligation survives termination of your access to the Site.

 

1. Termination

 

Tactical Aquatics may restrict or terminate your access to the Site or Services at any time without notice. Upon termination, you must cease all use of the Site. Tactical Aquatics is not liable for any resulting loss.

 

1. Governing Law

 

These Terms are governed by the laws of Ontario and the federal laws of Canada. You submit to the exclusive jurisdiction of Ontario courts for any disputes.

 

1. Copyright

 

All digital media and course materials produced by Tactical Aquatics are owned exclusively by Tactical Aquatics. No content may be reproduced or distributed without written permission.

 

1. Assignment

 

Tactical Aquatics may assign or transfer its rights under these Terms without notice. You may not assign your rights without written consent.

 

1. Injunctive Relief

 

Tactical Aquatics may seek injunctive or equitable relief if you breach these Terms, without needing to prove actual damages.

 

1. Amendments

 

These Terms may only be amended in writing by authorized representatives of Tactical Aquatics.

 

1. Independent Legal Advice

 

By using the Site or Services, you acknowledge that you have had the opportunity to review these Terms thoroughly and obtain independent legal advice.
